Privacy Policy
Last updated: September 2026
1. Introduction
FondAds ("we," "us," or "our") provides an AI-powered platform that generates video advertisements ("Service"). This Privacy Policy explains what information we collect through our website and Service, the legal basis for processing it, how we use and share it, and the choices and rights available to you.
2. Information We Collect
- Contact and campaign information: Name, email address, phone number, business name, website, industry, and campaign details (target audience, goals, brand tone, key message, and related creative input) submitted through our forms.
- Creative and reference content: Any text, brief, or creative direction you submit to help us prepare your ad. If a form ever allows you to upload images, logos, or reference material — including photos of real, identifiable people — we treat that as a distinct, more sensitive category of data and will only collect it with your explicit consent at the point of submission. As of this policy's last update, our contact form accepts text-based creative input only and does not accept file or image uploads.
- Technical and device information: Automatically collected data such as IP address, browser and device type, pages visited, and referral source, gathered through strictly necessary cookies required for the site to function (see Section 8, "Cookies and Tracking").
- Payment information: We do not currently process payments directly on this website. If and when paid plans go live, payment details will be collected and processed by a third-party payment processor (e.g., Stripe); we do not store full card numbers on our own systems.
3. Legal Basis for Processing (EU/UK Visitors)
If you are located in the European Economic Area or United Kingdom, we rely on the following legal bases under the GDPR/UK GDPR to process your personal information:
- Contract: processing your inquiry and preparing ad concepts you've requested.
- Legitimate interests: operating, securing, and improving our website and Service.
- Consent: sending marketing communications, and collecting any optional or sensitive content you choose to submit (see Section 2).
- Legal obligation: where processing is required to comply with applicable law.
4. How We Use Your Information
- To respond to your inquiry and prepare ad concepts for your business.
- To generate the video ad you've requested, including sending relevant inputs to the third-party AI/ML infrastructure that renders the video (see Section 5).
- To communicate with you about your request and, where you've opted in, to send occasional product updates or marketing emails — every marketing email includes an unsubscribe link, and you can opt out at any time.
- To improve our Service and website.
We do not use the business information or creative content you submit to train third-party AI models beyond what's necessary to generate the specific ad you requested, and we do not feature your generated ad publicly (e.g., in our Examples gallery) without asking for your separate consent first.
5. How We Share Your Information
We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We share information only with the following categories of service providers, solely to operate and provide the Service:
- AI/ML and video-generation infrastructure providers: to render the video ads you request.
- Workflow-automation and CRM tools: to route and respond to your inquiry.
- Cloud hosting providers: to run our website and Service.
- Payment processors: if and when paid plans go live.
Some of these providers may process data outside your country of residence, including the United States. Where required, we rely on appropriate safeguards (such as Standard Contractual Clauses) for these transfers. We may also disclose information if required by law, or in connection with a merger, acquisition, or sale of assets, in which case this Privacy Policy would continue to apply to your information under the new ownership.
6. Data Retention
We retain inquiry and campaign data for as long as needed to respond to your request and deliver the Service, and generally delete it within 24 months of your last interaction with us unless you ask us to delete it sooner, we need to keep it longer to comply with a legal obligation, or an active engagement is still ongoing.
7. Your Rights
Depending on where you live, you have rights over your personal information. To exercise any of these, contact us at the details in Section 11 — we'll respond within 30 days (GDPR/UK GDPR) or 45 days (CCPA/CPRA) as applicable. We may need to verify your identity before completing a request.
- If you're in the EU/UK (GDPR/UK GDPR): you have the right to access, rectify, erase, or restrict processing of your data, to data portability, to object to processing, and to lodge a complaint with your local supervisory authority.
- If you're a California resident (CCPA/CPRA): you have the right to know what personal information we've collected, to delete it, to correct it, and to opt out of the sale or sharing of personal information and limit use of sensitive personal information. We do not sell or share personal information as defined by the CCPA, so no additional opt-out action is needed — if that ever changes, we will provide a "Do Not Sell or Share My Personal Information" link on this page.
- Everyone: regardless of location, you may unsubscribe from marketing emails at any time using the link in those emails.
8. Cookies and Tracking
Our website currently uses only strictly necessary cookies required for the site to function — we do not use analytics, advertising, or third-party tracking cookies at this time. Because we don't use non-essential cookies, no cookie consent banner is currently required for EU visitors under the ePrivacy Directive. If we introduce analytics or advertising cookies in the future, we will update this policy and, where required, request your consent before setting them.
9. Figures, Likeness, and Third-Party AI Processing
FondAds generates ads featuring characters drawn from a curated library of mythological gods, legendary folk heroes, fairy tale archetypes, and public domain literary characters (e.g., Hermes, Thor, Robin Hood, Sherlock Holmes). We deliberately avoid real, named historical people, since their likenesses can carry publicity or estate rights that persist even after copyright expires — see our FAQ for more detail.
If a future version of our Service allows you to submit a photo or likeness of a real, identifiable person (for example, your own team or customers) to be used in a generated ad, that submission will require your explicit consent and a representation from you that you have the right to submit that person's image. We treat such submissions as biometric/likeness data and will disclose any change to this practice by updating this section before the feature goes live.
10. Children's Privacy
Our Service is intended for businesses and is not directed to individuals under 18. We do not knowingly collect personal information from children under 13 (or under 16 where required by law). If we learn we've collected information from a child in violation of this policy, we will delete it promptly — contact us if you believe this has occurred.
11. Changes to This Policy
We may update this Privacy Policy from time to time. We will post the updated version on this page with a new effective date, and where a change materially affects your rights (particularly for EU/UK or California users), we will also notify you by email or a prominent notice on our site.
